These Terms of Service ("Terms") constitute a legally binding agreement between you ("you", "your", "User") and FitBond Inc Ltd, a company registered in England and Wales under company number 17020972, whose registered office is at Flat 23, 112 Candlemakers Apartments, York Road, London SW11 3RS, United Kingdom ("FitBond", "we", "us", "our"). By creating an account, accessing, or using the FitBond mobile application and associated services (the "Service"), you agree to be bound by these Terms in full.
If you do not agree to these Terms, you must not use the Service.
1. Definitions & Interpretation
In these Terms, the following definitions apply:
"Bond" means a fitness commitment created through the Service in which a User sets a fitness Goal, deposits a monetary amount, and undertakes to achieve that Goal within a specified timeframe.
"Deposit" means the monetary amount (denominated in GBP) that a User commits when creating or joining a Bond.
"Goal" means the specific, measurable fitness target attached to a Bond (e.g., a daily step count, cumulative distance, number of gym visits, or calorie target).
"Cycle" means a recurring period within a Bond during which a User must meet their Goal (e.g., a weekly cycle within a 4-week Bond).
"Pot" means the aggregate of all Deposits contributed by Participants in a multi-participant Bond.
"Participant" means any User who has joined a Bond and whose payment has been authorised.
"Wallet" means the User's GBP balance held within the Service, which may be used to fund Deposits.
"Marketplace Points" means non-monetary loyalty units earned through eligible activity and redeemable for merchant offers. Marketplace Points are not legal tender and have no cash value.
"Coupons" means the cash-equivalent prize balance, recorded in integer pence, that may be awarded when a Bond settles. Coupons are separate from Marketplace Points and may be redeemed only through withdrawal methods that the Service makes available, subject to stated minimums and checks.
"Marketplace" means the section of the Service where Users may spend Marketplace Points on offers, discounts, and rewards provided by third-party merchants.
"Platform Fee" means the percentage fixed on a Bond when it is created and applied at settlement. For a Pro-created Bond, the current rate is 15% of forfeited Deposits; special Bond types may use a different basis disclosed before joining.
Bond Types:
- "Standard Bond" — A Bond in which a User who meets their Goal receives their Deposit back.
- "Head-to-Head Bond" — A Bond between two Participants in which the Participant who meets their Goal (or achieves greater progress) wins the combined Deposits of both Participants.
- "Team Bond" — A Bond in which multiple teams compete. Members of the winning team share the Pot (distributed equally or proportionally based on individual performance, as specified at Bond creation).
- "Charity Bond" — A Bond in which FitBond applies the disclosed charitable amount after a Participant fails to meet their Goal, using the approved direct-charity or intermediary route displayed before commitment.
- "Event Bond" — A Bond tied to a real-world fitness event, verified through geo-location or QR code check-in at the event start and finish. Eligible Participants may earn Marketplace Points upon verified completion.
- "Lottery Bond" — A promotional Bond in which FitBond sets a fixed prize before the Bond opens. Participants pay a Deposit as a commitment fee. One winner is selected at random from among Participants who successfully meet their Goal. The fixed prize is secured by FitBond — not from Participants' Deposits. FitBond bears the commercial risk of the promotion.
- "Prize Draw Bond" — A free promotional Bond sponsored and operated by FitBond, with a fixed prize. No purchase, Deposit, payment, or FitBond subscription is required. One winner is selected at random from among Participants who successfully meet the displayed Goal.
- "Product Bond" — A Bond in which the winner receives a physical product or voucher provided by a sponsoring brand. The winner is determined by first-to-complete or random selection among finishers, as specified at Bond creation.
- "Shame Bond" (legacy only) — A discontinued Bond type retained solely to settle any pre-existing Bond created when the feature was available.
- "Equity Bond" — A Bond in which rewards are distributed proportionally among Participants based on their individual performance relative to others.
- "Trainer Bond" — A Bond linked to verified personal training sessions, in which completion is confirmed jointly by the User and their trainer.
2. Eligibility & Account Registration
2.1 Age Requirement
You must be at least eighteen (18) years of age to use the Service. By creating an account, you represent and warrant that you are at least 18 years old. FitBond reserves the right to request proof of age at any time and to suspend or terminate accounts where this requirement is not met.
2.2 Account Creation
To use the Service, you must create an account using one of the following authentication methods:
- Email address and password
- Apple Sign-In
- Google Sign-In
You may only create and maintain one (1) account. Creating multiple accounts is a violation of these Terms and may result in the suspension or termination of all associated accounts and forfeiture of any Wallet balance or active Deposits.
2.3 Accuracy of Information
You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You are solely responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account.
2.4 Account Security
You must notify FitBond immediately at support@fitbond.co.uk if you become aware of any unauthorised use of your account. FitBond shall not be liable for any loss arising from unauthorised access to your account where such access resulted from your failure to safeguard your credentials.
3. Nature of the Service
3.1 Behavioural Fitness Platform
FitBond is a behavioural fitness platform designed to help users achieve their fitness goals and improve health outcomes. The Service is grounded in established scientific research in behavioural economics, including but not limited to:
- Loss aversion (Kahneman & Tversky, 1979) — prospect theory describes the value function as generally steeper for losses than gains; the original paper does not establish a universal multiplier for every person or context;
- Commitment devices (Bryan, Karlan & Nelson, 2010) — voluntary arrangements that bind an individual to a course of action they might otherwise fail to pursue;
- Financial incentives for health behaviour change (Volpp et al., 2008) — a small randomized trial found improved short-term weight-loss outcomes in incentive groups, while longer-term between-group differences were not statistically significant.
The monetary Deposit is intended as a voluntary commitment device. Research does not guarantee that it will improve any individual User's behaviour or health outcome. It is not presented as medical treatment.
3.2 Not Gambling
The Service is a fitness commitment platform, not a gambling or betting service. A Participant's physical activity determines whether they complete a Bond Goal. A Lottery Bond, Prize Draw Bond, or Product Bond may then use a random draw among successful qualifiers under the separate official rules disclosed before entry.
Specifically:
(a) Bond Goals are personalised. Where applicable, Goals are calculated based on the individual User's own historical fitness data and profile information collected during onboarding. A User competes against their own ability, not against chance.
(b) Success or failure is within the Participant's sole control. A Participant who performs the required physical activity will meet their Goal. A Participant who does not perform the required activity will not.
(c) Chance does not determine whether a Participant completes a fitness Goal. Where a promotional Bond uses random selection after qualification, chance determines only which verified qualifier receives the fixed promotional prize.
(d) Lottery Bonds and Product Bonds, in which a winner is selected at random from among successful Participants, are promotional competitions funded by FitBond or a sponsoring brand. The fixed prize is set and funded in advance by the promoter — it is not drawn from Participants' Deposits. Participants' Deposits function as commitment fees for the fitness programme. The promotional prize and the commitment fee are economically and structurally separate.
(e) FitBond makes paid promotional Bonds available only where its location policy permits and applies the separate eligibility, entry, and draw controls stated in the official rules.
3.3 Health & Wellness Purpose
FitBond exists to improve health outcomes in an environment where healthcare is becoming increasingly inaccessible. The Service is designed to make evidence-based fitness motivation available to everyone. The use of financial commitment is a tool in service of this health mission — it is the mechanism, not the purpose.
4. Bonds & Deposits
4.1 Creating and Joining Bonds
Users may create Bonds by specifying a fitness Goal, duration, Deposit amount, and Bond type. Other Users may join applicable Bonds (e.g., Head-to-Head, Team, Lottery, Product, Event, or Equity Bonds) by authorising their own Deposit.
4.2 Payment Authorisation
When you create or join a Bond with a monetary Deposit, the amount is charged at creation or acceptance. Card and Apple Pay payments are processed by Stripe; Wallet-funded Deposits are deducted from the Wallet immediately. If creation or joining fails before the Bond is committed, FitBond voids or refunds the payment as applicable.
4.3 Bond Outcomes
Upon conclusion of a Bond:
- If you meet your Goal, any Deposit refund and additional share due under the Bond rules is credited as Coupons.
- If you fail to meet your Goal, the already-paid Deposit is distributed in accordance with the Bond type and its fee snapshot (see Section 5).
4.4 Cancellation & Refunds
You may cancel your own participation for a full refund within twenty-four (24) hours of joining. A creator may cancel a pending Bond before it starts, in which case joined Participants are refunded. If a Team or Head-to-Head lobby does not fill by its start deadline, FitBond cancels it and refunds funded Participants. After the applicable cancellation window and once a Bond is running, there is no ordinary right to exit; documented exceptional-circumstance and statutory rights still apply.
4.5 Bond Modifications
Once a Bond has been created and at least one Participant's payment has been authorised, the Goal, Deposit amount, duration, and Bond type cannot be modified. This ensures fairness to all Participants.
5. Pot Distribution & Rewards
5.1 Standard Bonds
If you meet your Goal, your Deposit refund and any share due under the rules are credited as Coupons. If you fail, your Deposit is added to the settlement Pot.
5.2 Head-to-Head Bonds
The winning Participant receives the settlement amount as Coupons after the applicable Platform Fee. Exact tie and qualifying rules are displayed before joining.
5.3 Team Bonds
Members of the winning team share the Pot. Distribution may be equal among all winning team members or proportional to individual performance, as specified at the time of Bond creation. The Platform Fee is deducted before distribution.
5.4 Charity Bonds
After successful Participants' refunds are accounted for, 15% of final forfeited Charity Bond Deposits is retained as FitBond's Platform Fee and the remaining 85% becomes FitBond's donation obligation through the charity arrangement shown before commitment. Successful Participants receive their full Deposit back. A participant commitment is not a charitable donation by that Participant and is not eligible for individual Gift Aid.
5.5 Equity Bonds
Rewards are distributed proportionally among Participants based on individual performance relative to all other Participants. The Platform Fee is deducted before distribution.
5.6 Lottery Bonds
The Lottery Bond entry amount is non-refundable and is not a refundable Deposit. Entry amounts accrue to FitBond. One qualifying finisher is selected at random to receive the fixed prize secured separately by FitBond. If no Participant qualifies, the prize is not drawn. The Lottery Bond Official Rules govern eligibility, entry, selection, and prize administration.
5.6A Prize Draw Bonds
Prize Draw Bond entry is free. No purchase, Deposit, payment, or FitBond subscription is required. One qualifying finisher is selected at random to receive the fixed prize secured by FitBond. The Prize Draw Bond Official Rules govern eligibility, entry, selection, and prize administration.
5.7 Product Bonds
The winner receives the specified product or voucher. The winner is determined by first-to-complete or random selection among finishers, as specified at Bond creation. All Participants who meet their Goal receive their Deposit back.
5.8 Shame Bonds
Shame Bonds cannot be newly created or joined. Any pre-existing Shame Bond continues under the rules accepted when it was created; where technically available, an authorised pre-agreed social post may be attempted after failure. Social-provider outages do not change the monetary settlement.
5.9 Trainer Bonds
Completion is verified jointly by you and your personal trainer. Any settlement credit and Marketplace Points follow the rules shown before joining.
5.10 Event Bonds
Completion is verified through geo-location or QR code check-in at the event start and finish. Eligible successful Participants may earn Marketplace Points. Any Deposit settlement follows the rules shown before joining.
5.11 Platform Fee
The current Platform Fee is 15%. For Bonds created by a User whose subscription is in trial or active status, the fee is applied to the losing Participants' forfeited pool, allowing successful Participants to receive their full Deposit refund before sharing the post-fee remainder. The fee and basis are frozen when the Bond is created and shown before joining. Lottery Bond entry amounts follow Section 5.6 instead.
5.12 Marketplace Point Rewards
Eligible Pro members currently earn 50 Marketplace Points for successful Bond completion. Other point awards may be available for activity streaks, food logging, events, and referrals. Marketplace Points are separate from settlement Coupons. See Section 11.
6. Wallet, Coupons & Withdrawals
6.1 FitBond Wallet
Your Wallet records GBP funds available to pay Deposits. Bond settlement refunds and winnings are credited separately as Coupons. FitBond Inc Ltd is responsible for the balances and payments promised under these Terms. These app balances are internal records, not individual bank accounts. Using a regulated payment provider does not by itself give you protection against FitBond’s insolvency. We do not promise that Wallet or Coupon balances are held in trust or covered by the Financial Services Compensation Scheme.
6.2 Top-Up Methods
Available funding methods are shown in the Service and may include debit or credit card, Apple Pay, or existing Wallet balance. A method shown in these Terms is not a promise that it is available in every territory or build.
6.3 Withdrawals
Where enabled, Coupons may be redeemed through the payout method shown in the Service. The current minimum redemption is £10 (1,000 pence). Payouts can be delayed or rejected for verification, sanctions, fraud, provider, or compliance checks. Wallet top-up funds are not automatically withdrawable through the Coupon-redemption flow.
6.4 FitBond Is Not a Bank
Your Wallet is not a bank account, savings account, or e-money account. FitBond is not a bank, building society, or electronic money institution. Your Wallet balance is not protected by the Financial Services Compensation Scheme (FSCS) or any equivalent deposit protection scheme. Your Wallet balance does not earn interest.
6.5 Wallet Limits
FitBond may impose reasonable limits on Wallet balances, top-up amounts, and withdrawal amounts for security and regulatory compliance purposes. Any such limits will be communicated to you within the Service.
6.6 Coupon Bank Withdrawals
You may redeem available settlement Coupons to your bank account through Stripe Global Payouts, subject to a normal minimum of £10 and completion of the required bank and identity checks. Select your country of residence and provide your own bank details in Stripe's hosted form. Availability depends on the supported destination, currency and payment method; it does not establish eligibility to enter a paid Bond.
Before confirming, you will see the Coupon amount in GBP, the bank destination and the quoted amount in the receiving currency. FitBond covers the payout-processing fees shown for this flow. Currency quotes expire and must be reviewed again if they are no longer valid. Bank arrival times vary; “sent to bank” means the transfer has left Stripe and does not confirm that your bank has credited it. Confirmed failed or returned transfers restore the corresponding Coupons. A payment whose outcome is uncertain remains under reconciliation to avoid paying it twice. Existing withdrawals through another provider remain on their original route until resolved. For a balance below £10 or account closure, contact support as described in section 19.3.
7. Subscriptions
7.1 Subscription Tiers
FitBond offers a Free tier for discovering and joining eligible free Prize Draw Bonds without a purchase or subscription. FitBond Pro unlocks paid and advanced Bond participation. Pro is currently £7.99 per month or £59.99 per year, permits up to six concurrent active Bonds, and permits a Deposit of up to £500. The price and introductory offer shown in the App Store purchase sheet govern if they differ from this document.
7.2 Free Trials
New subscribers may be eligible for a free trial period:
- Monthly subscriptions: 7-day free trial
- Annual subscriptions: 14-day free trial
You will not be charged during the trial period. If you do not cancel before the trial expires, your subscription will automatically convert to a paid subscription and your payment method will be charged.
7.3 Billing & Auto-Renewal
Subscriptions are purchased through the Apple App Store and managed by Apple, with entitlement status synchronized through RevenueCat. They auto-renew unless cancelled in the User's Apple subscription settings. Cancellation takes effect at the end of the paid or trial entitlement period. Apple's billing and refund rules apply.
7.4 Price Changes
FitBond reserves the right to change subscription prices. We will provide at least thirty (30) days' written notice of any price increase. Continued use of a paid subscription after a price change constitutes acceptance of the new price.
8. Fitness Data & Tracking
8.1 Supported Data Sources
The Service integrates with the following fitness data sources to track progress toward Bond Goals:
- Apple Health (HealthKit) — steps, distance, calories, workouts
- Fitbit — steps, distance, calories, activity
- Strava — runs, rides, swims, workouts
- Whoop — strain, recovery, activity
- Gym Geofencing — gym visit verification via device location
8.2 How Data Is Handled
- Apple Health activity data used for Bond progress is processed on your device. Only the resulting Bond progress is sent to our servers. If you use weight tracking, body-mass readings (date, kilograms, and scale timestamp) are uploaded to and stored by FitBond so the Service can provide weight history, trends, averages, and goal projections.
- Fitbit, Strava, and Whoop data is synchronised server-side at regular intervals (typically every 4–12 hours) using authorised API access that you grant when connecting your account.
- Gym geofencing uses your device's location services to verify your physical presence at a registered gym location. Location data is used solely for visit verification and is not stored beyond verification.
8.3 Data Accuracy
FitBond relies on data provided by third-party fitness trackers, devices, and platforms. We do not guarantee the accuracy, completeness, or timeliness of this data. Bond outcomes are determined based on the data available to us at the time of evaluation. FitBond is not responsible for inaccuracies in third-party data, synchronisation delays, device malfunctions, or API outages that may affect your tracked progress.
8.4 Anti-Cheating
FitBond reserves the right to investigate and take action against any Participant suspected of manipulating fitness data, including but not limited to GPS spoofing, step simulation, use of automated devices, or exploitation of API vulnerabilities. If FitBond determines, in its reasonable judgement, that a Participant has engaged in data manipulation:
- The affected Bond(s) may be voided;
- The Participant's Deposit may be forfeited;
- The Participant's account may be suspended or terminated;
- Any Wallet balance may be frozen pending investigation.
8.5 Nutrition & Food Logging
The Service includes features for tracking nutritional intake, including calorie tracking, macronutrient logging, meal logging, and barcode scanning.
(a) Food Database. The Service uses third-party food and nutrition databases (which may include USDA FoodData Central, Open Food Facts, and FatSecret) to populate food item information. FitBond does not guarantee the accuracy or completeness of nutritional data provided by these third-party sources.
(b) Entry Methods. You may log foods manually, by searching the database, or by scanning barcodes. Where available, calorie and activity data may also be imported automatically from connected fitness trackers.
(c) Not Medical or Dietary Advice. Nutrition features are provided for informational and motivational purposes only. They do not constitute medical, nutritional, or dietary advice. You should consult a qualified healthcare professional or registered dietitian before making significant changes to your diet, particularly if you have any medical condition, dietary restriction, history of disordered eating, or are pregnant, breastfeeding, or under 18.
(d) Calorie & Macro Targets. Where the Service suggests daily calorie or macronutrient targets, these are estimates based on general formulas and the information you provide. They are not personalised medical recommendations.
(e) Eating Disorder Safeguards. If you have a history of disordered eating, you should exercise caution when using calorie and food tracking features. If you are in crisis, please contact your healthcare provider or an appropriate support service (in the UK: Beat on 0808 801 0677).
8.6 Onboarding & Profile Data
During onboarding, the Service collects information about your demographics, fitness background, health status, behavioural preferences, and goals in order to personalise your experience, calibrate Bond Goals, and recommend suitable Bond types. You are not required to provide every piece of information requested, but some features may be limited without it. See the Privacy Policy for full details on how this information is used.
9. Charity Donations
9.1 How Charity Bonds Work
In a Charity Bond, the charitable payment is conditional on a Participant's failure becoming final under the Bond rules. At the current 15% Platform Fee, 85% of that Participant's forfeited Deposit becomes FitBond's payable donation. The fee and charitable percentage are shown before commitment and fixed on the Bond. A successful Participant receives the full Deposit back.
9.2 Recipient and Intermediary Models
The pre-commitment disclosure identifies which of these models applies:
- Direct charity: FitBond has an effective written arrangement with the named charity and the charity is the specified beneficiary of FitBond's contribution obligation.
- Intermediary: FitBond contributes through the named giving intermediary. The User's selected charity is a recommendation or allocation instruction subject to the intermediary's terms, verification, legal control, and any right to redirect funds when the selected organisation cannot receive them.
The direct and intermediary models are not interchangeable after a Bond is accepted. The charitable percentage and FitBond Platform Fee are displayed before commitment. Payment-processing or provider deductions may reduce the charity's eventual net receipt but do not reduce FitBond's recorded donation obligation.
9.3 Charity Verification
FitBond displays Charity Bond recipients only while the relevant approval and operational route are active. FitBond may suspend Charity Bond creation and pledging immediately if no approved charity or intermediary is available. Existing obligations remain governed by the terms accepted for that Bond.
9.4 Tax Treatment
Charity Bond forfeits are not eligible for Gift Aid because the donation is made by FitBond, not the Participant. Friend Donate pledges do not use Gift Aid during the pilot. If FitBond later offers a separate unconditional donation flow that supports Gift Aid, its eligibility and declaration will be presented separately by the receiving charity or intermediary. FitBond does not provide tax advice.
9.5 Donation Receipts
FitBond or its payment provider will provide a payment record for a Friend Donate pledge. This is not an official Gift Aid receipt. Any charitable acknowledgement is governed by the receiving charity's or intermediary's terms.
10. Friend Pledges
10.1 How Friend Pledges Work
Users may invite friends to make a Donate pledge on an eligible Charity Bond. A Friend Pledge is a website payment by a third party ("Pledger") between £2 and £500. The iOS app opens the FitBond website and does not collect Friend Pledge payment details.
10.2 Donate Pledges
Only Donate pledges are available during the pilot. The disclosed charitable amount is applied through the Bond's approved charity route regardless of whether the User succeeds or fails. Friend Pledges are not credited to the User as Coupons. FitBond receives no Platform Fee from the charitable amount.
10.3 Binding Nature
A Friend Pledge becomes binding once the Pledger confirms payment through Stripe's hosted checkout. It is not refunded based on the Participant's outcome. Refunds remain available where required by law and may be considered for fraud, duplicate or unauthorised payments, technical error, or another exceptional compliance reason. The applicable charity or intermediary route cannot be changed after payment merely at the Pledger's request.
10.4 Legal Consent
By making a Friend Pledge, the Pledger confirms that they are at least 18 years of age, that they authorise the payment described, and that they accept these Terms. The version of these Terms accepted and the Pledger's IP address are recorded at the time of the pledge.
11. Marketplace Points
11.1 Earning Marketplace Points
Marketplace Points may be earned through eligible engagement with the Service:

11.2 Redeeming Marketplace Points
Marketplace Points may be spent to unlock offers and discounts from third-party merchants. An unlocked offer generates a unique token or QR code, normally valid for twenty-four (24) hours and usable once unless the offer states otherwise.
11.3 Nature of Marketplace Points
Marketplace Points:
- Are not real currency and have no cash value;
- Cannot be withdrawn, transferred, sold, or exchanged for money;
- Cannot be transferred between User accounts;
- Are personal to the User who earned them;
- Are granted at FitBond's discretion.
11.4 Expiration
Marketplace Points expire twelve (12) months after the date on which they were earned. Expired Points are automatically deducted from your balance. FitBond will make reasonable efforts to notify you before Points expire but is not obligated to do so.
11.5 Modifications
FitBond reserves the right to modify earning rates, redemption requirements, expiration periods, and Marketplace offers. Changes do not convert Marketplace Points into money or settlement Coupons.
11.6 Merchant Offers
Merchant offers listed on the Marketplace are provided by independent third-party merchants. FitBond is not the seller, supplier, or provider of the goods or services offered. Any purchase, redemption, or interaction with a merchant is a transaction between you and that merchant, subject to the merchant's own terms and conditions. FitBond is not responsible for the availability, quality, fulfilment, or honouring of merchant offers.
11.7 Referral Programme
The Service includes a referral programme that allows you to invite new users via a unique referral code.
(a) Rewards. When a person you refer creates an account using your referral code and meets the qualifying conditions specified in the Service, both you and the referred person may be awarded Marketplace Points or other rewards as determined by FitBond from time to time.
(b) Fair Use. Referral codes are for personal use. You may not use your referral code in connection with spam, paid advertising, or any form of incentivised distribution that misrepresents the nature of the Service. You may not create multiple accounts to claim referral rewards.
(c) Modification or Termination. FitBond may modify, suspend, or terminate the referral programme, or change reward amounts, at any time without notice. Rewards already credited will not be revoked except in cases of abuse, fraud, or violation of these Terms.
12. Communications & Third-Party Integrations
12.1 Push Notifications & In-App Messages
With your permission, the Service sends push notifications and in-app messages regarding matters including, but not limited to: Bond progress, upcoming deadlines, milestones, payouts, friend invitations, community updates, and streaks. You may adjust your notification preferences at any time within the Service's settings or via your device's notification controls.
12.2 Service Communications
FitBond may send you transactional emails or messages relating to your account, Bonds, payments, subscriptions, security alerts, and legal notices. These communications are necessary for the operation of the Service and cannot be opted out of while you maintain an account.
12.3 Marketing Communications
With your explicit consent, FitBond may send you marketing communications about new features, promotions, and offers. You may withdraw your consent to marketing communications at any time by following the unsubscribe link in any such message or by adjusting your preferences in the Service.
12.4 Third-Party Sign-In
You may create or access your account using third-party sign-in services (Apple Sign-In, Google Sign-In). When you do so:
- You authorise FitBond to receive certain profile information (typically your name and email address) from that third-party service in accordance with the permissions you grant;
- Your use of the third-party service remains subject to that service's own terms and privacy policy;
- FitBond does not receive or store your third-party account password.
12.5 Social Media Integrations
New Shame Bonds are no longer offered. A legacy social connection may remain for a pre-existing Shame Bond created when that feature was available. Ordinary achievement and Bond sharing uses the device's share sheet and occurs only when you choose it.
You may disconnect social media integrations at any time within the Service. Disconnecting does not affect posts already made. Your use of the social media service remains subject to that provider's own terms.
12.6 Fitness Tracker Integrations
When you connect a third-party fitness tracker or platform (Fitbit, Strava, Whoop, Apple Health), you authorise FitBond to access fitness and activity data in accordance with the permissions you grant. You may revoke this access at any time through the Service settings or through the third-party provider's account settings. Revoking access may prevent the Service from tracking progress toward active Bonds, which may result in Bond failure if your progress cannot be verified.
12.7 Location Services
Certain features (such as gym geofencing for Gym Bonds, Event Bonds with geo check-in, and the geo-located Marketplace) require access to your device's location services. You may grant, restrict, or revoke location permissions at any time through your device settings. Revoking location permissions may prevent you from participating in features that depend on location verification.
13. Prohibited Conduct
You agree not to:
(a) Manipulate or falsify fitness data, including but not limited to GPS spoofing, step simulation, use of mechanical or automated devices to generate activity, or exploitation of tracker API vulnerabilities;
(b) Create or maintain more than one account, or use another person's account;
(c) Collude with other Participants in any Bond to manipulate outcomes, share winnings, or otherwise undermine the integrity of the Bond;
(d) Use the Service for money laundering, fraud, terrorist financing, or any other unlawful financial activity;
(e) Share, sell, or transfer your account credentials or Wallet balance to any other person;
(f) Use any automated software, bot, scraper, or other tool to interact with the Service;
(g) Reverse engineer, decompile, or disassemble any part of the Service;
(h) Interfere with, disrupt, or impose an unreasonable burden on the Service's infrastructure;
(i) Use the Service in any manner that violates any applicable law or regulation;
(j) Circumvent or attempt to circumvent any security measures, access controls, or usage limits implemented by FitBond.
Violation of this section may result in immediate account suspension or termination, forfeiture of Wallet balance and active Deposits, and referral to law enforcement where appropriate.
14. Payment Processing
14.1 Payment Providers
Bond payments and Friend Pledges are processed by Stripe Payments Europe, Ltd. ("Stripe"). Coupon bank withdrawals use Stripe Global Payouts and its applicable provider terms. App subscriptions are processed by Apple and synchronized through RevenueCat. By using a provider flow, you also agree to that provider's applicable terms.
14.2 Payment Method Fees
Any payment-processing amount charged to the User is shown before confirmation. Provider rates can change and are separate from the Platform Fee used at Bond settlement.
14.3 Chargebacks & Disputes
If you initiate a chargeback or payment dispute with your bank or card issuer in respect of a transaction processed through the Service, FitBond reserves the right to:
- Immediately suspend your account pending investigation;
- Debit any disputed amount from your Wallet balance;
- Terminate your account if the chargeback is determined to be fraudulent or unjustified.
FitBond will cooperate with Stripe and your payment provider to resolve disputes. You agree to contact FitBond at support@fitbond.co.uk before initiating a chargeback to allow us to resolve the matter directly.
14.4 Failed Payments
If payment creation, authorization, or capture fails when a Bond is created or joined, that operation will not complete. FitBond may retry a provider operation where it is safe and idempotent to do so. A settlement does not normally capture a new Deposit payment because funded Deposits were already captured when the Participant entered.
15. Intellectual Property
15.1 FitBond's Intellectual Property
The Service, including but not limited to its design, user interface, logos, branding, text, graphics, software, algorithms, and all other content created by FitBond, is the exclusive property of FitBond Inc Ltd and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the Service without FitBond's prior written consent.
15.2 User Content
By uploading or submitting any content to the Service (including profile photographs, display names, and social media posts in connection with Shame Bonds), you grant FitBond a worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, display, and distribute such content in connection with the operation of the Service.
You represent and warrant that you own or have the necessary rights to any content you submit, and that such content does not infringe the rights of any third party.
16. Privacy & Data Protection
16.1 Privacy Policy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand how we collect, use, and protect your personal data.
16.2 Data Protection
FitBond processes personal data in compliance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. FitBond Inc Ltd is the data controller for the purposes of applicable data protection legislation.
16.3 Third-Party Data Processors
In the course of providing the Service, FitBond uses the following third-party data processors:
- Amazon Web Services (AWS) — cloud hosting and authentication services
- Stripe — payment processing
- RevenueCat — subscription management
- Fitbit, Strava, Whoop — fitness data synchronisation (only when you connect your account)
Each processor is bound by its own data processing terms and privacy commitments.
16.4 Health Data
Apple Health activity data used for Bond verification is processed locally and only derived Bond progress is transmitted. When you use weight tracking, Apple Health body-mass readings are transmitted to and stored on FitBond's servers to provide your personal weight history and trends. Fitness data from third-party providers (Fitbit, Strava, Whoop) is transmitted to and stored on FitBond's servers with your explicit consent, granted when you connect your account. You may revoke Apple Health or provider access at any time to stop future collection.
17. Disclaimers & Limitation of Liability
17.1 Service Provided "As Is"
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, FitBond disclaims all warranties, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
17.2 No Medical Advice
FitBond is not a medical service. The Service does not provide medical advice, diagnosis, or treatment. You should consult a qualified healthcare professional before beginning any fitness programme. FitBond is not responsible for any injury, illness, or adverse health outcome resulting from your use of the Service.
17.3 Third-Party Services
FitBond is not responsible for the availability, accuracy, or reliability of third-party services, including fitness trackers, data APIs, payment processors, merchant offers, or charity organisations. Outages, errors, or delays in third-party services that affect Bond outcomes are not the responsibility of FitBond.
17.4 Limitation of Liability
To the maximum extent permitted by applicable law:
(a) FitBond's total aggregate liability to you for any and all claims arising out of or related to these Terms or the Service shall not exceed the total amount of Platform Fees and subscription fees paid by you to FitBond in the twelve (12) months immediately preceding the event giving rise to the claim.
(b) FitBond shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill.
(c) FitBond is not liable for any Deposit forfeited as a result of your failure to meet a Bond Goal. The forfeiture of Deposits upon failure is a fundamental feature of the Service's behavioural design and is the intended consequence of not meeting your commitment.
17.5 Consumer Rights
Nothing in these Terms excludes or limits FitBond's liability for (a) death or personal injury caused by negligence, (b) fraud or fraudulent misrepresentation, or (c) any other liability that cannot be excluded or limited under applicable law, including the Consumer Rights Act 2015.
18. Dispute Resolution
18.1 Informal Resolution
Before initiating any formal dispute, you agree to contact FitBond at support@fitbond.co.uk and allow thirty (30) days to attempt to resolve the matter informally.
18.2 Mediation
If informal resolution is unsuccessful, the parties agree to attempt mediation administered by the Centre for Effective Dispute Resolution (CEDR) before commencing court proceedings.
18.3 Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales.
18.4 Jurisdiction
The courts of England and Wales shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, subject to your statutory right (if applicable) to bring proceedings in the courts of your country of residence.
18.5 Individual Claims
All disputes shall be resolved on an individual basis. You agree not to bring or participate in any class action, collective action, or representative proceeding against FitBond.
19. Termination
19.1 Termination by You
You may delete your account at any time through the Service or by contacting support@fitbond.co.uk.
19.2 Active Bonds
If you request account deletion while you have active paid Bonds, their payments must first be resolved:
- Cancel an eligible Bond through the Service or contact support to arrange cancellation and the applicable refund;
- Bonds already in progress remain subject to their accepted rules and must be settled, or refunded where applicable, before deletion can complete. Contact support if you need help resolving an active commitment.
19.3 Wallet Balance After Termination
Deleting your account does not forfeit a remaining payable Wallet or Coupon balance. Contact support@fitbond.co.uk to arrange its return or redemption, including amounts below the normal £10 Coupon cash-out minimum; you do not need to make another Deposit to reach that minimum. We will verify ownership and check for pending payments, refunds and disputes before arranging payment. Unsettled Bond commitments must first be settled or refunded under their applicable rules; contact support if you cannot resolve them in the app. We retain the limited financial records needed to resolve your claim and meet applicable record-keeping obligations. Dormant balances are handled under applicable law, including any unclaimed-property reporting or remittance requirements, rather than automatically becoming FitBond revenue after 90 days.
19.4 Termination by FitBond
FitBond reserves the right to suspend or terminate your account at any time, with or without notice, if:
- You violate these Terms;
- We are required to do so by law;
- Your account is involved in suspected fraud, money laundering, or other illegal activity;
- Continued provision of the Service to you is no longer commercially viable.
Termination does not itself make a payable balance FitBond revenue. Active Deposits remain subject to their accepted Bond rules. We may restrict a payment where required by law or while a relevant dispute or suspected fraud is investigated; remaining payable balances are handled under section 19.3.
20. Modifications to These Terms
FitBond reserves the right to modify these Terms at any time. For material changes, we will provide at least thirty (30) days' advance notice via email and/or in-app notification before the changes take effect.
Your continued use of the Service after the effective date of any modification constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service and delete your account.
21. General Provisions
21.1 Entire Agreement
These Terms, together with the Privacy Policy and any supplemental terms presented within the Service, constitute the entire agreement between you and FitBond regarding the Service and supersede all prior agreements and understandings.
21.2 Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
21.3 No Waiver
FitBond's failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
21.4 Assignment
FitBond may assign its rights and obligations under these Terms to any successor entity (whether by merger, acquisition, or otherwise) without your consent. You may not assign your rights or obligations under these Terms without FitBond's prior written consent.
21.5 Force Majeure
FitBond shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond its reasonable control, including but not limited to natural disasters, pandemics, government actions, internet or power failures, or third-party service outages.
21.6 Third-Party Rights
These Terms do not confer any rights on any person or party other than you and FitBond. No third party may enforce any provision of these Terms under the Contracts (Rights of Third Parties) Act 1999.
